General Terms and Conditions of On-Line Sale

1 - Sales prices
The prices of products on sale are shown in Rupees and include GST. 
The price shown on the website at the time of the placing the order is applied.

2 - Payment methods

3. COD facility will be made available through Aipex Worldwide (OPC) Pvt. Ltd. It may please be noted, cheque or Demand Draft is not acceptable for COD shipment. Additionally, minimum Rs. 100/- will be collected from the customer for COD shipment.

Proforma invoice as per requirement of valued customers and bank details for payment per RTGS will be provided.

 

3 - Shipping

It may please be noted, shipping is free for domestic orders having invoice value over Rs. 600/-. If however, value of domestic orders is blow Rs. 600/-, a charge of Rs. 110/- will be applicable.

Pin Code list of AIPEX may please be checked from its website. If the client’s location is not covered in the Pin Code list, Out of Delivery Area charges is applicable and is to be collected from the client.

For international shipping, standard courier rates as per the service provider is applicable.

Every order is shipped to a single destination address only. If the products are to be shipped to different addresses, multiple orders are required to be placed for each destination.

It will remain the best endeavour to ship all the items under a single order at one time; however in case of unavailability of any product, shipment of the order will be made in parts.

All possible care is taken to dispatch the products with sound packaging. If the packaging is found tampered or damaged, delivery of the package may please be refused and we may be informed at address / email id given below:

Re: COD shipment:

It may please be noted, cheque or Demand Draft is not acceptable for COD shipment.
Additionally, minimum Rs. 100/- will be collected from the customer for COD shipment.

 

4 - Exchange policy

In case of any problem, any fault or any defect in the Fabriano product you have, it may please be returned to the place / address from where the Fabriano product is purchased.

If however, valued customer of Fabriano product desires to exchange the same for any other reason, below stated Fabriano Service Centre may please be contacted. In case the customer desires to exchange the product with a product of higher value, differential amount will be payable by customer.

Please pack the product properly and seal the packet completely before handing over to the courier service provider to avoid in-transit damages. Also use separate packets for items from different orders.

Upon evaluation of the reason for exchange of Fabriano product, our Service Centre will assist you in returning the product through a reliable courier service within seven days of receiving the product. Please note, courier charges shall be borne by the customer.

It may however please be noted that if Fabriano product is personalized or customized by the customer, it will not be eligible for return or exchange. Besides, the product received in damaged or broken condition will not be eligible for return or exchange.

All exchange claims will be ineligible if the customer doesn't raise the exchange claim as per the Terms mentioned here.

Fabriano reserves the right to accept or reject the exchange claim of customer post inspection of the returned product. Exchange approved claim, replaced product will be shipped to customer.

 

Cancellation instruction

If a customer wishes to cancel the order that is placed on website, the customer has to write or email to us at the address give below within 24 hours of receipt of the product. Our Customer Care personnel will help to cancel the order.

Post this, customer needs to ship the product back to us and on receiving the same we will check the quality of the product and process the customer’s cancellation request. Please note, any personalized products will not be eligible for cancellation and for refund or for exchange.

5. Warranties
6.1 The Supplier warrants that the goods sold are free of faults that make them unsuitable for the use for which they are intended or which appreciably decrease their value. 
All products offered for sale by the Supplier are covered by legal warranties. 
6.2 If a defect emerges within two years after delivery of the goods, the Customer-Consumer (as defined in Article 3 of the Consumer Code – Legislative Decree n° . 206/05) can implement the legal warranty by notifying the defect within 2 months from the date of its discovery. The consumer is required to prove and specify the time when the defect was discovered. 
On notifying the defect, the Customer may request the Supplier to provide the following alternatives: 
- reinstate the conformity of the goods by means of replacement; 
- an appropriate price reduction or termination of the contract if replacement is impossible or excessively burdensome. 
After two years from the date of delivery of the product, the Supplier shall not be liable for conformity defects found by the Customer-Consumer. 
Reference is made, in any case, as regards governance of legal guarantees to Articles 128 and thereafter of the Consumer Code. 
6.3 The Customer who is not a consumer (as defined in Article 3 of the Consumer Code – Legislative Decree n° . 206/05) is entitled to enact the legal warranty provided for in the Civil Code but shall cease to be covered by said warranty if the defects in question are not notified to the Supplier within eight days of discovery. The Customer is required to prove and specify the time when the defect was discovered. The legal warranty for the Customer who is not a consumer is valid for a maximum period of 12 months from delivery of the product. After this period, the Supplier will not be held liable for conformity defects found by the customer. 
6.4 In any case, the notification must be made in writing addressed to the Supplier and should contain a detailed description of the nature and extent of the fault and/or defect in question, the product identification label and a copy of the packing slip or invoice. 
Notification not accompanies by the features and content as indicated above cannot be accepted as a valid complaint and will not therefore avoid the effect of the above-mentioned expiry term. 
6.5 The Customer shall keep the goods delivered at the disposition of the Supplier in order to enable necessary investigations. 
The Supplier, on confirming the validity of the complaint, where possible shall replace non-conforming or defective products with products of the same quantity and quality of those covered by the sales contract. In this case, the Supplier may request the return of the defective products at the expense of the Customer. 
The Supplier will not be held liable for any further present or future damage and/or losses suffered by the Customer and will only respond to the extent of the value of the goods supplied and ascertained as faulty. 
6.6 The warranty does not apply if the Customer cannot provide evidence of having correctly used and kept the products subject to complaint.

 

6. Personal data processing
The customer's personal data is processed by the Supplier in accordance with the dispositions of Regulation (EU) 2016/679 (General Data Protection Regulation). See the Privacy notice at this link.

8. Applicable law and Place of jurisdiction 
These general conditions of sale are governed by Italian law and construed pursuant thereto. Consequently, the interpretation, execution and termination of the General Terms and Conditions of Sale shall be subject exclusively to Italian law and any disputes relating to and/or arising from them shall be exclusively settled by Italian judicial authorities. 
In particular, if the Customer is a consumer, any disputes shall be settled by the Courts in the place of domicile or residence of said person in accordance with applicable law or, at the choice of the consumer in the event of action taken by the consumer in person, by the Courts of Verona. 
If the Customer on the other hand is an operator of a company, trade, small business or profession, by mutual agreement the parties agree to the exclusive competence of the Courts of Verona.
